It is an established fact that smoking is practised in a solitary way by one person meaning that they are doing it on their own without the use of anyone else to be claiming so by the law that punishes, financially, indoor smoking. The English philosopher coming from Middlesex John Stuart Mill calls this a self-regarding action and compares it to other-regarding actions, where a self-regarding action concerns the interests of no other person but their own performing the action.
Indeed, the constitution of a given country is there in effect to protect the liberty of each citizen and protect their freedom so they can do what they want on their own. Indeed, for somebody to be smoking they could find themselves alone in the world and smoke in the same way that they are smoking among people which proves that smoking is not inflicted onto anybody else.
To this logical statement and conclusion it is claimed by the legislation and its false justification as a smoking ban that people around you in the same space can smell and breath in your smoke and with this argument that smoking is inflicted onto the rest, but from those who are present in the same area.
We will prove why this is not the case that smoking is inflicted onto others and especially only those coinciding in the same surrounding area who also happen not to smoke. The reason they feel as if smoking is inflicted onto them is because they are present in the same area in comparison to the fact that somebody else is smoking there, and secondly this is in conjunction to the fact that they are presumed not to smoke. Two possible answers exist when they are complaining about passive smoking, which is that they can choose to find themselves somewhere else and that they can start smoking themselves and bring them in the same position.
However, the superimposed legislation of the smoking ban with its proponents and fanatical supporters and advocates decided to inflict onto smokers the physical presence and location of their position in order to alter it and displace them outside in the open air to smoke while smoking is not inflicted upon but it is rather the same position of the rest that causes the impression of doing so. This is called the logical law of anti-metathesis meaning of opposite infliction or opposite direction of influence of the same event and is unacceptable to be used to justify differences between people and their interests.
