‘In catering or drinking establishments, including those with rooms or spaces intended for dancing, places where smoking is allowed in areas intended for customers may be set up, provided that these establishments have an area for customers equal to or greater than 100 m^2 and a minimum ceiling height of 3 metres.’ is provided for by Law 157 of 2022 in Portugal recently drawn up after cooperation of the Portuguese Ministries of Finance, Shipping and Health.
According to the new law passed by the Parliament in Portugal, smoking will be allowed in most hospitality and catering venues including restaurant areas in special areas that can be set aside for this purpose, at a maximum of 20% of an area exceeding 100 square meters of total area having at least 3 metres of ceiling height from the floor. Minors will be prohibited from entering the enclosed spaces segregated for smoking despite the fact that often underage children are encouraged in Portugal according to a traditional custom by their parents etc. to smoke for the celebrations during the annual feast of the Epiphany.
Despite the fact that 20% of shops with a sufficient area of 100 square meters occupy one fifth of their total area, smoking will only be allowed there in the vast majority of them in Portugal as far as restaurants and other entertainment venues are concerned.
